AGREEMENT TO OUR LEGAL TERMS

We are Wellness 4 Warriors (“W4W,” “we,” “us,” or “our”), a nonprofit organization based in Texas, United States, located at:

We operate the website https://www.wellness4warriors.us (the “Site”), as well as any related pages, forms, online portals, SMS communications, email communications, or services that link to these Legal Terms (collectively, the “Services”).

These Terms and Conditions (“Legal Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Wellness 4 Warriors, concerning your access to and use of the Services.

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Legal Terms.
IF YOU DO NOT AGREE WITH THESE LEGAL TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or additional policies (collectively, “Supplemental Terms”) may be posted on the Services from time to time (including, without limitation, our Privacy Policy, Veteran Confidentiality Statement, Donor Privacy Supplement, and SMS Terms). All such Supplemental Terms are hereby incorporated by reference into these Legal Terms.

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will notify you of any changes by updating the “Last updated” date above. You waive any right to receive specific notice of each change. It is your responsibility to review these Legal Terms periodically to stay informed of updates. Your continued use of the Services after any changes constitutes acceptance of the revised Legal Terms.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

We recommend that you print or save a copy of these Legal Terms for your records.

1. OUR SERVICES

Wellness 4 Warriors is a nonprofit organization dedicated to supporting U.S. veterans and their families through financial assistance, wellness programs, and community connections. Our Services may include:

• Information about W4W programs (e.g., Operation Access, Operation Clarity, Operation Restore, Operation Family)
  
• Online applications for assistance
  
• Donor and sponsorship information and forms
  
• Volunteer sign-up forms

The information provided on or through the Services is for general informational and educational purposes only and does not constitute medical advice, legal advice, financial advice, or professional counseling.

The Services are not intended for use in any jurisdiction or country where such use would be contrary to law or regulation or would subject us to any registration requirement within such jurisdiction or country. If you access the Services from other locations, you do so on your own initiative and are responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations such as HIPAA, FISMA, or the Gramm-Leach-Bliley Act. If your interactions with the Services would be subject to those laws, you may not use the Services in that manner.

2. INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

We are the owner or licensee of all intellectual property rights in the Services, including, without limitation:

• Site design and layout
  
• Logos, marks, and branding
  
• Text, graphics, images, and audiovisual content
  
• Databases, code, and functionality (collectively, the “Content”)
  
• Names, logos, and other identifiers associated with Wellness 4 Warriors (the “Marks”)
  

The Content and Marks are protected by copyright, trademark, and other intellectual property laws in the United States and internationally.

The Content and Marks are provided on an “AS IS” basis and may be used solely for your personal, non-commercial purposes in connection with the Services.

Your Use of Our Services

Subject to your compliance with these Legal Terms (including Section 7, “Prohibited Activities”), we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Services
  
• Download or print a copy of portions of the Content that you have lawfully accessed, for your personal, non-commercial use only
  

Except as expressly stated in these Legal Terms, no part of the Services, Content, or Marks may be copied, reproduced, modified, distributed, publicly displayed, transmitted, or otherwise exploited for any commercial purpose without our prior written permission.

If you wish to use the Services, Content, or Marks in ways not expressly authorized by these Legal Terms, you must request permission by emailing info@wellness4warriors.us.

We reserve all rights not expressly granted to you in and to the Services, Content, and Marks. Any unauthorized use may result in termination of your access to the Services and may violate intellectual property laws.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

1. You have the legal capacity and agree to comply with these Legal Terms.
   
2. You are not a minor in the jurisdiction in which you reside (you are at least 18 years of age).
   
3. You will not access the Services through automated or non-human means (e.g., bots, scripts, scraping tools).
   
4. You will not use the Services for any illegal or unauthorized purpose.
   
5. Your use of the Services will not violate any applicable law or regulation.
   

If any information you provide is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your access to the Services.

4. DONATIONS AND SUPPORT

The Services may allow you to:

• Make donations to support Wellness 4 Warriors
  
• Become a recurring donor or sponsor
  
• Register for fundraising events
  
• Provide in-kind or other forms of support
  

All information about your donation, including any restrictions or designations, is governed by:

• These Legal Terms
  
• Our Donor Privacy Supplement
  
• Any applicable Donation Disclosure displayed on donation pages
  

We reserve the right to decline or return any donation at our discretion, including if it appears to be fraudulent, restricted in ways we cannot honor, or inconsistent with our mission or legal obligations.

5. PAYMENTS AND DONATION PROCESSING

Donations or payments made via the Services are typically processed by third-party payment processors. By submitting a donation or payment, you agree to:

• Provide accurate, current, and complete payment information
  
• Authorize the payment processor to charge your selected payment method
  
• Take full responsibility for charges, including any fees or taxes applied
  

Payment is generally accepted in U.S. dollars (USD).
We reserve the right to correct any errors, including pricing or transactional errors, even after a transaction is submitted.

For recurring donations, you authorize W4W (via the payment processor) to automatically charge your selected payment method according to the schedule you choose. You can adjust or cancel recurring donations by contacting us or following instructions provided in your donor portal or email confirmations (if applicable).

6. REFUNDS POLICY

As a general policy, donations are non-refundable.

If a technical error or duplicate transaction occurs, or if you believe an error has been made in processing your donation, please contact us promptly at info@wellness4warriors.us. We will review each such request on a case-by-case basis and may issue refunds at our discretion where appropriate and permissible by law.

Event registrations, sponsorships, or other contributions are also generally non-refundable, unless a specific event or campaign page expressly states otherwise.

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavor, except as specifically approved by us in writing.

As a user of the Services, you agree not to:

• Systematically retrieve data or other Content from the Services to create or compile a database or directory without our written permission.
  
• Trick, defraud, or mislead us, especially in connection with donation information, applications, or identity.
  
• Circumvent, disable, or interfere with security-related features of the Services.
  
• Disparage, tarnish, or otherwise harm, in our opinion, W4W or the Services.
  
• Use information obtained from the Services to harass, abuse, or harm another person.
  
• Make improper use of our support services or submit false reports of abuse or misconduct.
  
• Use the Services in violation of any applicable law, regulation, or nonprofit solicitation rule.
  
• Engage in unauthorized framing of or linking to the Services.
  
• Upload or transmit viruses, malware, or any other harmful code.
  
• Engage in any automated use of the system (e.g., bots, spiders, scrapers) without our written permission.
  
• Delete or alter any copyright or other proprietary rights notice from the Content.
  
• Impersonate another user or person or use another person’s identity or account.
  
• Use any information obtained from the Services to discriminate, harass, or target veterans, donors, or staff.
  
• Interfere with or place an undue burden on the Services or networks connected to the Services.
  
• Harass, threaten, or intimidate any W4W employees, volunteers, or agents.
  
• Attempt to bypass any measures designed to prevent or restrict access to the Services or any portion thereof.
  
• Reverse engineer or decompile any software related to the Services, except as permitted by law.
  
• Use the Services as part of any effort to compete with us or to operate a similar or competing platform.
  

We reserve the right to take appropriate legal action for any violation of this section.

8. USER GENERATED CONTRIBUTIONS

From time to time, the Services may allow you to submit or post content, including:

• Comments, testimonials, or stories
  
• “Wall of Honor” dedications
  
• Feedback or suggestions
  
• Photos or materials you voluntarily share
  

(Collectively, “Contributions”).

Contributions may be visible to other users, to the public, or used by W4W in communications or campaigns, in accordance with our Privacy Policy and any additional terms you accept when submitting such content.

By submitting Contributions, you represent and warrant that:

• You own or have the right to use and share the Contributions.
  
• Your Contributions are accurate, not misleading, and do not infringe any third-party rights.
  
• Your Contributions do not contain unlawful, defamatory, threatening, discriminatory, obscene, or otherwise objectionable material.
  
• You have permission from any identifiable individuals shown or mentioned in your Contributions.
  

We reserve the right (but not the obligation) to remove or edit Contributions at our discretion.

9. CONTRIBUTION LICENSE

By submitting Contributions to the Services, you grant W4W a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, and create derivative works of such Contributions in any media now known or hereafter developed, for legitimate nonprofit purposes including, without limitation, storytelling, awareness, marketing, reporting impact, and donor communications.

You retain ownership of your Contributions.
We do not claim ownership over them; we simply require the above license to use them in connection with our mission.

You agree that W4W may use your Contributions without compensation, provided such use is consistent with our mission and policies.

10. THIRD-PARTY WEBSITES AND CONTENT

The Services may contain links to third-party websites, resources, or content (“Third-Party Content”). These are provided for your convenience only.

We do not monitor or control Third-Party Content and are not responsible for:

• Its accuracy, reliability, or completeness
  
• Any products or services offered through such sites
  
• The privacy practices or policies of such sites
  

Your use of Third-Party Content is at your own risk and is governed by the terms and policies of those third parties.

11. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:

1. Monitor the Services for violations of these Legal Terms;
   
2. Take legal action against anyone who violates these Legal Terms or applicable law;
   
3. Refuse, restrict, or limit access to the Services to any user at any time and for any reason;
   
4. Remove or disable any Content or Contributions that are excessive, harmful, or violate these Legal Terms;
   
5. Manage the Services to protect our rights and to facilitate the proper functioning of the Services.
   

12. PRIVACY POLICY

We care about privacy and data security. Please review our Privacy Policy, Veteran Confidentiality Statement, Donor Privacy Supplement, and SMS Terms, all of which form part of these Legal Terms by reference.

By using the Services, you agree to the practices described in these policies.

The Services are hosted in the United States. If you access the Services from outside the U.S., you understand and consent to the transfer and processing of your data in the United States.

13. TERM AND TERMINATION

These Legal Terms remain in effect while you use the Services.

We reserve the right, in our sole discretion and without notice or liability, to:

• Deny access to the Services to any person for any reason
  
• Terminate or suspend your use of the Services
  
• Block certain IP addresses or accounts
  

If we terminate or suspend your access, you are prohibited from creating a new account under your own name or a third party’s name.

We may also pursue legal remedies if necessary.

14. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to modify, suspend, or discontinue the Services, or any part thereof, at any time for any reason without notice.

We are not liable to you or any third party for any modification, change, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times and may experience interruptions, errors, or delays. You agree that we will not be liable for such interruptions or for any loss or damage caused by them.

15. GOVERNING LAW

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

16. DISPUTE RESOLUTION

Informal Negotiations

Before filing any formal claim, you agree to first attempt to resolve any dispute (“Dispute”) with us informally for at least thirty (30) days by contacting info@wellness4warriors.us with a description of the issue.

Binding Arbitration

If a Dispute cannot be resolved informally, it shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will take place in or near Parker County, Texas, unless otherwise mutually agreed.

YOU UNDERSTAND THAT BY AGREEING TO ARBITRATION, YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

Restrictions

To the fullest extent permitted by law:

• Arbitrations are conducted on an individual basis only.
  
• No class actions or representative claims are permitted.
  

Exceptions

These arbitration provisions do not apply to:

• Claims related to the enforcement or validity of our intellectual property rights
  
• Claims for injunctive relief due to threatened or actual infringement or misuse of intellectual property
  

17. CORRECTIONS

The Services may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct these at any time without prior notice.

18. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED
  
• DEFECTS WILL BE CORRECTED
  
• THE CONTENT IS ACCURATE, COMPLETE, OR CURRENT
  

THE SERVICES DO NOT PROVIDE MEDICAL, LEGAL, OR PROFESSIONAL ADVICE. ALL MEDICAL DECISIONS MUST BE MADE BETWEEN VETERANS AND THEIR LICENSED HEALTHCARE PROVIDERS.

19. LIMITATIONS OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELLNESS 4 WARRIORS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU DONATED TO W4W IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations of liability; in such cases, these limitations may not apply to you and we will be liable only to the extent required by law.

20. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Wellness 4 Warriors, its officers, directors, employees, volunteers, and agents from and against any losses, damages, liabilities, claims, or expenses (including reasonable attorneys’ fees) arising out of:

1. Your use of the Services;
   
2. Your breach of these Legal Terms;
   
3. Your violation of any third-party rights;
   
4. Your Contributions or misuse of Content.
   

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.

21. USER DATA

We maintain certain data related to your use of the Services for operational and record-keeping purposes. Although we may perform routine backups, you are responsible for any data you transmit or store via the Services.

We are not liable for any loss or corruption of such data and you waive any claims arising from such loss or corruption.

22. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By accessing the Services, sending us emails, or completing online forms, you are communicating electronically and consent to receive communications from us electronically.

You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

You agree to the use of electronic signatures and records for transactions initiated or completed via the Services and waive any rights under laws requiring otherwise.

23. SMS TEXT MESSAGING

Our SMS practices are governed by our SMS Terms.

By opting in to receive SMS messages from W4W, you consent to receive text messages related to:

• Applications and program updates
  
• Appointment reminders
  
• Donation confirmations
  
• Event and volunteer notifications
  

Message and data rates may apply. You may opt out at any time by replying STOP to any message.

25. MISCELLANEOUS

These Legal Terms and any policies or rules posted on the Services constitute the entire agreement between you and Wellness 4 Warriors.

Our failure to enforce any right or provision is not a waiver of such right or provision.
If any provision is found unlawful or unenforceable, the remaining provisions remain in full force and effect.

You may not assign or transfer your rights under these Legal Terms without our written consent. We may assign our rights and obligations at any time.

Nothing in these Legal Terms creates a partnership, joint venture, employment, or agency relationship between you and W4W.

You waive any defenses based on the electronic form of these Legal Terms.
